By accessing or using the MyDesigner website and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.
2. Description of Service
MyDesigner provides an online platform for interior design consultation, personalized furniture and decor recommendations (MyDesigner Capsules), and the facilitation of purchasing such items. Features and services are subject to change or termination without notice at our sole discretion.
3. User Accounts
You may be required to create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. User Conduct
You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, or impairs the service. You agree to provide accurate and current information as prompted by any registration forms.
5. Intellectual Property
All content on the Service, including text, graphics, logos, images, and software, is the property of MyDesigner or its licensors and is protected by copyright and other intellectual property laws. The MyDesigner Capsules and design recommendations provided to you are for your personal, non-commercial use only.
6. Product Purchases
MyDesigner facilitates the purchase of products from third-party manufacturers and suppliers. All purchases are subject to the respective manufacturer's terms, warranties, and return policies. We are not responsible for product defects, shipping issues, or warranty claims, but we will endeavor to assist you in resolving such matters.
Important: Prices and availability of products are subject to change without notice. We reserve the right to limit the quantity of items purchased per person, per household, or per order.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. MyDesigner does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
While we strive for accuracy, design recommendations, product information (including colors, dimensions, and materials), and pricing may occasionally contain errors or inaccuracies. We reserve the right to correct any errors and to change or update information at any time without prior notice.
8. Limitation of Liability
To the fullest extent permitted by applicable law, MyDesigner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.
10. Changes to Terms
MyDesigner reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
